A1. ORDINANCE NO. 2009-: An ordinance further amending various provisions of the LaVerkin City Code to correct dwelling designations to match designations as called out in International Building and Residential Codes as adopted by LaVerkin City Code.

B1. ORDINANCE NO. 2009-: An ordinance further amending Title 11 of the LaVerkin City Code to delete a phrase from Section 11-3-4 that references small subdivisions and lot splits, which were deleted from the Code by Ordinance 2008-18; and providing an effective date.

Call To Order: Chair Sanders at 6:00 p.m.
Joint Work Meeting: 6:00 p.m.
Planning Commission met with City Council in a joint work meeting to discuss priorities. Earlier this year, Planning Commission set priorities including - in order: Hillside Ordinance, Affordable Housing, Sexually Oriented Business (SOB)location designation, General Plan, Conditional Use Chapter, Construction Apron, OSMU permitted uses, Sign Setback.
Sanders read through the list, each item was discussed as to its purpose and importance.
The Hillside Ordinance was recently rewritten. The commission didn’t feel that the ordinance accomplished what was intended. Their current intent was to apply hillside definition and requirements not only on the east hillside, but to any area in town with similar characteristics. The board is working with the newly passed Washington Ordinance to make it relevant to LaVerkin. They are interested in preserving the natural beauty of the city.
The commission brought the SOB designation out because there is no current location allowed. There are conditions in the SOB code, but no location. It would be expected that an Industrial Zone would allow these types of businesses, but the LaVerkin Industrial Zone has been put on “reserve”. If an application were received, the city would have to allow them to go.
Affordable housing is a required element of the General Plan. When the plan was rewritten, it was assumed that this was to be part of that plan, but the Appendix was left without an article. An affordable housing plan was accepted in 2004 to meet the requirements of the state code.
The Conditional Use chapter needs to be addressed because it is no longer relevant since conditional uses in each zone have been changed to permitted uses.
Construction Apron is a 25’ X 50’drive approach into development with a spray station so that dirt is not tracked onto city streets. Dirt on the streets clogs curb & gutter.
OSMU is a zoned area on top that was never addressed with the changes to permitted uses.
Sign Set Back is to allow a shallow set back for signage on State Street where existing parking lots are too small to set back 25’. Also would like to address A-frame type signs similar to those at Farmer’s Market.
Mayor Wilson stated that his concern is the limited staff. He would like commission to be aware of the time it takes and would suggest one or two of the ordinances at a time. Kevin and June are used extensively in the office. All the suggestions are valuable to work on. Suggested setting a time frame.
Kevin had received concerns from a couple of members of the governing body about the Hillside Ordinance since it had just been rewritten. He suggested this work meeting to make sure that council and commission are together on the direction. He received the same concerns about the SOB reference on a recent agenda.
Discussion that SOB is important; affordable housing will not require a lot of action; General Plan is ongoing - working on the last chapter. Mayor has noticed that other cities are updating in the same way LaVerkin is.
Commission stated that while there is no active development, it is a good time to update the Hillside.
Beecher wondered how long the General Plan would take. He sees that as a top priority because the rest of code should be built on what is written in the General Plan. He expressed similar interest in the time it would take to complete each ordinance.
There was brief discussion about SOB location. It is possible that if SOBs were put into the OSMU zone, they could be worked in with the permitted use update without drawing attention to the particular item.
Wilson suggested that the priority list be amended as follows: 1) General Plan and Affordable Housing, 2) OSMU and SOB, 3) Hillside, 4) Conditional Use, 5) Sign set-back and Construction Apron together.
In connection with Affordable Housing discussion, Kyle Gubler informed the boards that DAWHAC is on permanent recess and will not be meeting any more at this time.
There was concurrence with the priority list from members of council and the commissioners.
Affordable housing needs to be done sooner rather than later. An update report is required by the State. That report is due. The State has inquired about the report. It is on its second draft and is expected to be ready to send in May.
Wilson would like the commission to spread out the work on ordinances to spare staff time. They could overlap, but not run concurrently.
Mayor informed the council and commission about the intended April 13th water board agenda. He is looking into a filtration system for the irrigation water. Sanders is interested in who to contact about opening the sloosh gates to clear out the river. Wilson gave those resources as US Fish and Wildlife, Virgin River Program, Utah Division of Natural Resources. The best area contact would be Steve Meismer. Sanders should talk to Wilson before doing anything. The Washington County Water Conservancy District has no responsibility to supply clear water and doesn’t want to “upset the apple cart” with the other government agencies. The more sediment that collects, the bigger the flood needs to be to clear the stream. Opening the gates allows sediment down the river to the area reservoirs. There will be further discussion at the water board meeting.

Approval of Agenda: Motion by Commissioner Andregg to approve the agenda, second by Commissioner Webb. Motion carried 5-0 with Bice, Webb, Sanders, Andregg, and Howard voting yes.
Reports:
Beautification Committee: Maurine Roberts stated that the beautification committee will give 4 awards from the contest this year. There will be certificates - (1) most improved, and (3) most beautiful - awarded. The most beautiful will be for the best desert landscaping, the best traditional landscaping and the best use of trees. Because of budget restraints there will be no money awards this year. The follow-up drive will be on April 18. The committee is also filing to be part of the “most beautiful community” contest. They don’t think they can win against Hurricane, but believe it is worthy to participate. The committee would like to put effort into improving the “crescent” at the intersection of 500 North and State where the LaQuinta was to be built.
Director of Operations: No report. Kyle Gubler informed the commission that Maverick has taken their development off the active list. It will be reviewed next year at this time to possibly activate.
