Present: Chair Pro Tem Allen Bice; Commissioners: Sherman Howard, Hugh Howard, and Karl Benson; Staff: Derek Imlay, Kevin Bennett and Christy Ballard; Public: Richard Hirschi, Patty Wise and John Valenti.
Anna Andregg was excused.
I. Call to Order: Chair Pro Tem Allen Bice called the meeting to order at 6:00pm. The Invocation and Pledge of Allegiance was given by Hugh Howard.
II. Approval of Minutes:
Commission may approve the minutes of the June 14, 2017 regular meeting.
Motion was made by Commissioner Karl Benson to approve the June 14, 2017 regular meeting minutes as written, second by Commissioner Hugh Howard. Hugh Howard-yes, Bice-yes, Benson-yes. Motion carried unanimously.
III. Approval of the Agenda
Motion was made by Commissioner Hugh Howard to approve the agenda as written, second by Commissioner Karl Benson. Bice-yes, Hugh Howard-yes, Benson-yes. Motion carried unanimously.
1. Beautification/Trails Committee-There has not been a meeting.
2. City Council-The last meeting was cancelled due to lack of quorum. Kevin did present the GRAMA/OPMA training.
Sherman Howard arrived at 6:02pm
3. Director of Operations-Derek reported Sunset View Estates should be ready for a public hearing in August.
1. Discussion on possible changes to the Vacation Rental Ordinance.
Derek explained he adjusted the boundary lines on the map so they follow roads as requested. The current vacation homes were marked on the map along with those that are in process and those that have been requested. He also included the amount of homes allowed under 5% and 7.5% for each section.
He would like to have the ordinance ready for the August 9th meeting and possibly set the public hearing at that time.
Kevin explained the packet included the current code with the suggested changes highlighted and either crossed out in red or added in blue. This would allow the Commissioners to see how the changes fit in both the business licensing and zoning sections of the code.
The parking requirements would remain at 1.1
Kevin explained the residential maximum would be 15 people in one house so the 1.1 parking requirement should be sufficient.
Commissioner Bice asked if renting one room in a home was allowed in La Verkin.
Kevin explained it is currently not allowed, however there has been a gentleman request the City discuss it.
Page 9-Section D, number 4 talks about providing off street parking. This item requires property owners to provide adequate off-street parking.
Commissioner Bice mentioned he liked the condition that a home will need to be used as a residence for at least one year before being made into a vacation rental.
Commissioner Benson said he does have some concern with limiting vacation rentals because of the “lottery mentality” it can create but agrees something needs to be done to limit them.
Kevin mentioned the requirement of utilizing the business license in a calendar year should prevent people from getting a license to either secure their spot for the future or prevent other people from having a vacation rental.
He pointed out by limiting vacation rentals in most commercial zones it may push them into residential zones.
Commissioner Sherman Howard commented he feels the market will regulate itself but he does like the base the ordinance gives.
Commissioner Hugh Howard said he is also concerned that limiting the number of rentals would push people to securing a license. He feels the ordinance is a good base to address the concerns of the citizens who feel vacation rentals will take over the community.
The Commissioners agreed to set the limit for vacation rentals at 7.5% per area.
Patty Wise-Asked about the number of vacation rentals at 7.5% in her specific area, which is Zion View Estates. That area currently has the most vacation rentals.
With the 7.5% limit, there could be two more.
She suggested making the information very clear to citizens before the public hearing to alleviate any confusion and frustration.
Kevin stated the ordinance addresses allowing single family dwelling vacation rentals in the R-3-6 and Mobile Home zones.
He will have the ordinance ready for the first planning commission meeting in August.
